THEWORLDOFHOST.COM LTD provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of THEWORLDOFHOST.COM LTD are subject to the following terms of service:

Indemnification Policy

You agree to use all THEWORLDOFHOST.COM LTD services and facilities at your own risk. THEWORLDOFHOST.COM LTD specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall THEWORLDOFHOST.COM LTD be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold THEWORLDOFHOST.COM LTD harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against THEWORLDOFHOST.COM LTD, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless THEWORLDOFHOST.COM LTD against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with THEWORLDOFHOST.COM LTD's server.

THEWORLDOFHOST.COM LTD reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from THEWORLDOFHOST.COM LTD's server. THEWORLDOFHOST.COM LTD shall be the sole judge of what violates this Policy.

Billing:

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee is nonrefundable).

We accept PayPal, Visa, Master Card, American Express, Discover Card. For webhosting plans we will setup your account without any paying. Clients are encouraged to pay by PayPal as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

n an effort to protect our clients' and site visitors privacy and rights, THEWORLDOFHOST.COM LTD has established a Privacy Policy which explains what information we gather on visitors and what we do with information that we gather.

This Privacy Policy governs the manner in which THEWORLDOFHOST.COM LTD collects, uses, maintains and discloses information collected from users of this Web site (each, a "User").

We do not store your credit card details

If you choose to pay for the Service using a Credit Card, Debit Card or other Card Payment, your card details are not stored by us and cannot be used by our staff.

Your credit card details are encrypted and securely stored by PayPal, to enable us to automatically bill your credit on a recurring basis.

Late Payments:

All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.

Acceptable Use Policy:

All services provided by THEWORLDOFHOST.COM LTD may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless THEWORLDOFHOST.COM LTD and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all THEWORLDOFHOST.COM LTD servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.

Banned Scripts:

The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

LIMITATION OF LIABILITY:

THEWORLDOFHOST.COM LTD shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from THEWORLDOFHOST.COM LTD servers going off-line or being unavailable for any reason whatsoever. Furthermore, THEWORLDOFHOST.COM LTD shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of THEWORLDOFHOST.COM LTD servers. All damages shall be limited to the immediate termination of service.

We do not monitor and will not have any liability for your Material or any other communication you transmit, or allow to be transmitted, by virtue of the Hosting Services.

Due to the public nature of the Internet, we shall not be liable for the protection of the privacy of electronic mail or any other information transferred through the Internet or via any network provider and no guarantee or representation is given that the Hosting Services will be free from hackers or unauthorised users. You shall be liable for the content of any emails transmitted by virtue of the Hosting Services, for any material you upload to, or allow to be uploaded to, our servers and for ensuring compliance at all times with all relevant legislation (including, but not limited to the Data Protection Act 1998 and all other privacy laws, regulations and guidance notes made or issued thereunder).

All conditions, terms, representations and warranties that are not expressly set out in these terms and conditions (or the documents referred to in them) are hereby expressly excluded.

We do not exclude or limit in any way our liability:

for death or personal injury caused by our negligence;

under section 2(3) of the Consumer Protection Act 1987;

for fraud or fraudulent misrepresentation; or

for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We will not be responsible for the following types of losses (in each case whether direct, indirect or consequential) and whether they are caused by our negligence or otherwise:

loss of income or revenue;

loss of business;

loss of profits or contracts;

loss of anticipated savings;

loss of goodwill;

loss of software or data;

wasted expenditure (such as pay per click advertising costs); or

wasted management or office time.

OUR LIABILITY:

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the Contract that is caused by events outside our reasonable control ("Force Majeure Event").

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

misuse, alteration or interference by you or any third party of our servers or systems (including virus and hacker attacks);

strikes, lock-outs or other industrial action;

civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

impossibility of the use of public or private telecommunications networks; and

 the acts, decrees, legislation, regulations or restrictions of any government.

Our performance under the Contract will be deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event

ENTIRE AGREEMENT:

These terms and conditions and any document expressly referred to in them represent the entire agreement between us both in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

We each acknowledge that, in entering into the Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.

Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.

OUR RIGHTS TO VARY THESE TERMS AND CONDICTIONS:

We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.

You will be subject to the policies and terms and conditions in force at the time that you order services from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Acceptance Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven (7) working days of receipt by you of the Acceptance Confirmation).

No variation of these terms and conditions shall be valid unless it is in writing and signed on our behalf.

DISCLAIMER:

THEWORLDOFHOST.COM LTD cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by THEWORLDOFHOST.COM LTD are resold. Thus, certain equipment, routing, software, and programming used by THEWORLDOFHOST.COM LTD are not directly owned or written by THEWORLDOFHOST.COM LTD. Moreover, THEWORLDOFHOST.COM LTD holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as THEWORLDOFHOST.COM LTD sees fit. FURTHERMORE, THEWORLDOFHOST.COM LTD retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
